In consideration for the willingness of Georgia Peach Pug Rescue Incorporated to accept my participation as a volunteer, and for other good and valuable consideration, the receipt and sufficiency of which are acknowledged, I do freely, voluntarily, and without duress execute this Release, and I understand, acknowledge, and agree as follows:
- Volunteer Activities.
(a) I agree to provide my services to Georgia Peach Pug Rescue Incorporated as a volunteer for purposes of supporting the organization’s fundraising events for rescue pugs (herein collectively referred to as “Activities”). I also agree that I am not, and will not be considered to be, an employee of Georgia Peach Pug Rescue Incorporated while participating in such Activities. I understand that the Activities may include, but are not limited to lifting, carrying, and setup of event canopies, pet enclosures, tables, chairs, booths, and shelves, as well as lifting, carrying, unpacking, and displaying totes containing administrative, booth, merchandise, store, and donated materials. I understand that the event is public-facing and that I will interact with adults and children, professionally, in provision of volunteer services, to include but not limited to reading booth activity instructions, accepting payments/donations, distributing candy and prizes, and providing directions to restrooms, food vendors, and event booths and activities. I understand that the event is canine-focused and that I will interact with dogs, including but not limited to, providing participants and attendees assistance with their dogs at canine-focused booths and activities, and distributing dog treats and prizes.
(b) I agree that Georgia Peach Pug Rescue Incorporated’s events are canine-focused and are advertised as open to the public and their “well-behaved dogs”. I understand that Georgia Peach Pug Rescue Incorporated allows volunteers to bring their own well-behaved dogs with them to the event. I understand that these fundraising events are hosted by local businesses that donate their space and accommodations (herein collectively referred to as “Partners”) to the rescue, and that, simultaneously, the Partners are open for business to the non-event attending public and their dogs (herein collectively referred to as “Clientele”). I understand that Georgia Peach Pug Rescue Incorporated is unable to place breed or weight restrictions on dogs at the event as it poses interference with the Partners’ day-to-day business operations and allowance of the Clientele’s dogs on the premises. I agree that dogs, even those deemed “well-behaved” can be unpredictable and volatile. I understand that in provision of my volunteer services at the event my dog (if in attendance) and I will be around dogs of varying breeds and weights and that all dogs on the premises pose a risk for reactivity.
- Assumption of the Risk.
(a) I understand that the Activities may involve circumstances or work that may be hazardous to me and my dog (if in attendance), and understand that inherently dangerous risks may include but are not limited to, travel to and from locations where Georgia Peach Pug Rescue Incorporated is holding fundraising events, including but not limited to, those caused by weather, temperature, terrain, condition of participants and attendees, equipment, vehicular and waterway traffic and actions of other people including, but not limited to, participants and attendees, Clientele, Partners and their staff, and Georgia Peach Pug Rescue Incorporated directors, officers, employees, agents, volunteers, successors, assigns, and other representatives on the premises. These risks are not only inherent to the volunteers and their dogs but are also present for those involved with Georgia Peach Pug Rescue Incorporated. I release, forever discharge, and hold harmless Georgia Peach Pug Rescue Incorporated and its directors, officers, employees, agents, volunteers, successors, assigns, and other representatives from any and all liability, claim, costs, or expense related to such risk as it pertains to me or my dog (if in attendance).
(b) I understand that dogs can be unpredictable and volatile and that every dog reacts differently. I understand and acknowledge that dogs may bite, scratch, or cause other injuries to humans and other dogs without warning or reason. I acknowledge and understand that there are certain risks involved with me or my dog’s (if in attendance) attendance or interactions with other humans and dogs in a social environment, including but not limited to dog fights, dog bites to humans or other dogs, and the transmission of disease. I release, forever discharge, and hold harmless Georgia Peach Pug Rescue Incorporated and its directors, officers, employees, agents, volunteers, successors, assigns, and other representatives from any and all liability, claim, costs, or expense related to such risk as it pertains to me or my dog (if in attendance).
(c) I hereby expressly and specifically assume the physical and psychological risks to me and my dog (if in attendance), in connection with such Activities, including but not limited to, damage, injury, harm, or death, including but not limited to, broken bones, cardiac arrest/heart attack, eye injury or loss of sight, ear injury or loss of hearing, drowning, concussion, joint, ligament or back injuries and heat exhaustion, strains, sprains, bites, bruises, scratches, cuts, abrasions, as well as online risks including but not limited to, data mining, phishing, viruses, malware, data breach of online information, cyberbullying, exploitation, victimization, cyber stalking, online grooming, cyber predators, and image replication. I release, forever discharge, and hold harmless Georgia Peach Pug Rescue Incorporated and its directors, officers, employees, agents, volunteers, successors, assigns, and other representatives from any and all liability, claim, costs, or expense related to such risk as it pertains to me or my dog (if in attendance).
(d) In addition to any other risks posed by participating or volunteering with Georgia Peach Pug Rescue Incorporated, I understand that, despite any safety precautions being taken by Georgia Peach Pug Rescue Incorporated, by participating or volunteering with Georgia Peach Pug Rescue Incorporated, there is a risk of potential human or canine exposure to harmful viruses or bacteria, which may result in illness or death. I release, forever discharge, and hold harmless Georgia Peach Pug Rescue Incorporated and its directors, officers, employees, agents, volunteers, successors, assigns, and other representatives from any and all liability, claim, costs, or expense related to such risk as it pertains to me or my dog (if in attendance).
(e) I have considered these risks and, relying on my own judgment, I have voluntarily chosen to participate in the Activity and assume all such dangers and risks.
- Waiver and Release of Liability.
(a) For myself and for my estate, heirs, legal and personal representatives, executors, successors and assigns, I hereby release, forever discharge, and hold harmless Georgia Peach Pug Rescue Incorporated and its directors, officers, employees, agents, volunteers, successors, assigns, and other representatives (collectively the “Released Parties”), from any and all liability, claims, losses, demands, costs, expenses, and causes of action whatsoever that I may have of whatever kind or nature, either in law or in equity, arising from or relating to me and my dog’s (if in attendance) participation in the Activities, whether or not resulting from negligence, all of which I hereby waive. I knowingly, voluntarily, and for adequate consideration release and waive, and further agree to indemnify, hold harmless, and reimburse each and all of those persons and entities referenced above, from an against any claim which I, my child, any other parent of my child, any relative or any next of kin of my child, or any other person, firm or corporation now or hereafter may have or claim to have (whether known or unknown, seen or unforeseen, directly or indirectly, or within or without the control of those persons and entities), for or on account of any losses, damages, bodily injuries, personal injuries, illness, pain and suffering, death, property damage, or contract claims resulting from, or arising out of, during, or in connection with my or my dog’s participation in such Activity, or the ownership, operations, use, maintenance, or control of any vehicle, equipment or goods provided or used in connection with such Activity, or in any way connected with or arising out of instruction, training, emergency care, or operations incidental to such Activity, regardless of whether caused in whole or in part by an act or omission of a Released Party.
(b) I understand that, except as otherwise agreed to by a Released Party in writing, the Released Parties do not provide any financial assistance of any kind, including but not limited to medical, health, or disability insurance coverage for any volunteer.
(c) If any emergency medical procedures or treatment are required during the Activity, I consent to the Activity supervisor undertaking, arranging for or consenting to the procedures or treatment in his, her or their discretion and that I will be responsible for any and all expenses or fees related to me or my dog’s (if in attendance) medical care. I acknowledge that neither Georgia Peach Pug Rescue Incorporated nor any of the above named entities shall be liable for any such fees or expenses under any circumstances. I release, forever discharge, and hold harmless the Released Parties from any claim, demand, or cause of action whatsoever arising from or relating to any first aid or medical treatment rendered to me or my dog (if in attendance) in connection with the Activities. I understand and agree that Georgia Peach Pug Rescue Incorporated assumes no responsibility for any injury or damage which might arise from or relate to such authorized emergency medical treatment.
- Media Release.
(a) I authorize, grant permission, and convey to Georgia Peach Pug Rescue Incorporated as well as their agents, representatives, and others working under their authority, all right, title, and interest in any and all photographic images and video or audio recordings made by or for Georgia Peach Pug Rescue Incorporated during my participation in the Activities, to take and use me or my dog’s (if in attendance) photographed, video recorded, or live-streamed image, likeness, voice, and name for any and all purposes, in perpetuity, including marketing, commercial, or advertising purposes, and in any and all forms of media, without further consideration. I understand and agree that I have no rights to any benefits derived from the use of such image, likeness, voice, or name, including but not limited to, any royalties, proceeds, or other benefits derived from such photographs and/or recordings. I understand that photos donated to Georgia Peach Pug Rescue Incorporated fall under the ownership of the Public Domain. I understand that, by granting Georgia Peach Pug Rescue Incorporated these rights, I waive any claim or action of any nature arising as a result of, or in connection with, the photographic session and/or use of me or my dog’s (if in attendance) photographic image.
- Miscellaneous.
(a) I certify that I am 18 years of age or older and that I am suffering from no legal disability.
(b) I warrant that my health and physical condition are sufficiently good to allow me to perform this assignment without danger to myself or to others.
(c) I have fully and carefully read this Release, fully understand its contents, and sign it freely and willingly, without coercion or undue influence, and upon full and mature consideration.
(d) I further agree that this Release is intended to be as broad and inclusive as permitted by the laws of the state of Georgia, and this Release shall be governed by and construed in accordance with Georgia law, without giving effect to its conflict of laws rules. I agree that the sole and exclusive jurisdiction and venue for litigation between myself and Georgia Peach Pug Rescue Incorporated will be a state or federal court having jurisdiction over Cobb County, Georgia.
(e) If any term or provision of this Release shall be held illegal, unenforceable, or in conflict with any law governing this Release, the validity of the remaining portions shall not be affected thereby.
